Zavvi Threatening Its Own Customers With Legal Action

A warehouse bungle has cost UK retailer Zavvi quite a bit of money. Instead of simply sending customers a pre-ordered copy of Tearaway, they accidentally sent them a Tearaway Vita bundle. A whole bunch of new Vitas for everyone!

While this could have been looked at as an astounding accidental act of Christmas cheer, Zavvi isn’t particularly in a cheerful mood. They have sent out notifications saying that they want to arrange for pickup of the PS Vita units that were accidentally mailed out. They read as follows:

We are very sorry to inform you that due to an error in our warehouse we have dispatched the incorrect product.

We are contacting you in order for us to arrange a collection of the incorrect item which is on the way to you.

If possible, please keep the parcel in its original packaging ready to hand back to the courier.

Unfortunately, for Zavvi that is, customers aren’t actually required to comply with their demands. According to the Distance Selling Regulations of the UK, any and all unsolicited items can be kept as an unconditional gift. Basically, they are not required to pay for them or send them back in any way.

Zavvi is trying to put on the pressure by saying that they will enforce any and/or all legal remedies available to them, but it appears as If they don’t have a legal leg to stand on. If anything, this is a very poor way to keep customers shopping with you. No one wants to shop at a store that would sue them due to the store’s own incompetence.
