We reported earlier on the trial of Matthew Crippen, the Xbox modder who is charged with two counts of violating the anti-circumvention provisions of the Digital Millennium Copyright Acts. After being berated by U.S. District Judge Philip Gutierrez, the prosecution has dismissed their case.

Prosecutor Allen Chiu told Judge Gutierrez that the “government has decided to dismiss the indictment.” The prosecution stated that their decision was reached “based on fairness and justice.”

The case against Crippen was the first jury-trial against an individual for video game modding. This case will likely set a precedent when dealing with this issue in the future.
