West/Zampella Claim Dismissed

Back in the days of Modern Warfare 2, we learned that Infinity Ward co-founders Jason West and Vince Zampella were forced to leave Activision. Due to some unscrupulous details surrounding their departure, they decided to sue Activision. Believe it or not, the trial still hasn’t begun, and it doesn’t look like it will anytime soon because West and Zampella have just had one of their claims dismissed by a judge.

The claim for fraudulent-inducement was dismissed by Judge Elihu Berle earlier this week. I am by no means a lawyer, but, as far as I can tell, the situation breaks down like this: Fraudulent-inducement refers to tricking someone into agreeing to a contract that is not in their best interests. This would mean that the judge believes that West and Zampella were fully aware of the terms of their employment and the consequences they would face if they sought out employment elsewhere.



West and Zampella’s second claim is for promissory fraud, which relates to a failure to pay money that was at one point promised in a contract or agreement. Since Activision fired both West and Zampella, they never received royalties from Modern Warfare 2. West and Zampella believe they are owed these royalties, so this claim still stands.
