I’m sure many of you Modern Warfare fans remember the very ugly, very public disintegration of Infinity Ward last year, but for those who have been left in the dark here’s the gist: Jason West and Vince Zampella, two senior employees at Infinity Ward, were fired in March of 2010 for “breaches of contract and insubordination.” This sparked a volley of heated remarks and eventually led to about 40 employees abruptly walking out on Infinity Ward. Well, West and Zampella finally have an official court date for the 36 million dollar lawsuit they’re bringing against Activision.

“We’re extremely pleased to have a firm trial date and the opportunity to let a jury decide Jason and Vince’s claims that Activision cheated them and 40 other Infinity Ward team members out of the millions of dollars they earned for creating the Call of Duty and Modern Warfare mega-franchises,” said an O’Melveny & Myers representative. “Activision has taken a lot of cheap, false shots at Vince and Jason and has tried to delay the case and drive up their cost of enforcing the promises Activision reneged on. But come May 7, 2012, Activision will have nowhere to hide.”



Aside from the monetary damages, West and Zampella are seeking ownership of the Modern Warefare franchise, which would give the duo the right to create sequels and franchise the title however they see fit.

However, all of this would be meaningless if Activision is awarded the $400 million in damages they are seeking in a countersuit. West and Zampella still have a long, expensive road in front of them.
