Tempers have been running high between Activision and their former employees, Vince Zampella and Jason West. Adding to the tension earlier last week, the lawsuit levied against the publisher by Zampella and West was deemed to have “sufficient claims against Activision” to proceed forward into trial.

Zampella and West, former heads of Infinity Ward, were fired from Activision last year, allegedly for insubordination. Their lawsuit against Activision asserts that the company wrongfully terminated them and was scheduled to pay them “substantial” royalties soon after the termination.



Activision has its own counter-suit, also approved to go forward, which describes the two as “self-serving schemers who attempted to hijack Activision’s assets for their own personal gain.” Activision later added EA to its complaint as a “co-conspirator.”

Zampella and West, who have gone on to found Respawn Entertainment, may still not be expected in court for months yet, during which a settlement on one or both cases could be reached. At this point, however, a trial is looking increasingly likely.
