Proof that forgetting about a bad thing doesn’t make it go away, Activision’s suit against Electronic Arts is still in the pipes. For those who need a refresher, Jason West and Vince Zampella, founders of Infinity Ward, sued Activision for breach of contract back in March of 2010 , relating to royalties not paid in the wake of Modern Warfare 2. Activision issued a countersuit against its former employees , accusing them of insubordination. Acctivision continued on to file a second suit against them , as well as EA itself, claiming that their actions undermined Call of Duty: Black Ops, and that EA used illegal measures to draw in Infinity Ward developers.



It may sound like a lot of hot air surrounding business as usual, but Judge Elihu Berle of the Los Angeles Superior Court has denied EA a summary judgment, indicating he feels that there is sufficient evidence to settle the matter of EA’s alleged interference in a jury trial. A similar such judgment was denied to West and Zampella in the suit Activision raised against them over their insubordination.

The suits, as well as West and Zampella’s suit against Activision, will convene on the same day: May 7, 2012, unless the parties reach a settlement beforehand.
